Labor figures to defend assault case
July 23, 2008 - 10:56AM
Former prime minister John Howard spent the closing stages of the campaign distancing himself from the issue, and Labor's David Bradbury went on to win Lindsay following the controversy.
Egan has brought a private legal action for assault against NSW senator Steve Hutchins, Transport Workers Union assistant state secretary Wayne Forno and Luke Foley, the assistant general secretary of the NSW ALP.
Mr Boulten told the magistrate the three were prosecution witnesses in the commonwealth's case against Egan and Clark.
Egan was allegedly photographed distributing the leaflets with a number of other men, including Clark.
Egan claims the three senior Labor figures grabbed him and shoved him up against a pole so his photograph could be taken during a sting that resulted in his arrest in November last year.
The private prosecution has been listed for mention on October 31, the first day of the hearing of the Electoral Act breach charge.
