Report of the HIH Royal Commission...

The Commissioner has identified a number of possible breaches of the Corporations Law and the Crimes Act (NSW). There are 56 matters that Mr Justice Owen has indicated should be referred either to the Australian Securities and Investments Commission (ASIC) or (in a small number of cases) to the NSW Director of Public Prosecutions. The Government is referring these possible breaches to those authorities immediately.

In respect of the Corporations Law referrals, a taskforce will be established immediately under the direction of ASIC to examine these issues and prepare briefs for possible proceedings. Additional funding will be provided in the budget for this task. The Government will give consideration to whether a Special Prosecutor will be appointed to prosecute criminal charges.

Privacy NSW

The collection and dissemination of personal information is governed by privacy laws. In collecting and providing indications of "negative feedback" to one or several agencies they could well be within breach of the law. There are no grounds for any person to either collect information about me without my consent or for any agency or law enforcement body to disseminate information about me and if any person has in fact done so they are I believe in breach of the Privacy Principles of the State of New South Wales and possibly subject to prosecution.

If I couple this with other matters (such as a recent letter from the Federal Attorney General of Australia) I may be referring the matter(s) to a solicitor. I will however leave the matter for a week as I have requested information from the agency. They are obliged under law to provide any information they may have about me. It is only after perusing this information that I will be in a position to know what (if any) action to take.

I am in a foul mood with regards to those who seek to misrepresent my views or defame me via the Internet as I believe has been the case on several occasions.
